Terms of Service

1. Agreement

These Terms of Service ("Terms") are a legal agreement between you and Moneo YAZILIM A.Ş. ("we," "us," "our"). They apply to the Hidden Eye mobile application (the "App") and any related services and websites. By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. What the App is, and what it is not

The App provides guidance and tools that use your phone's camera, sensors, network and Bluetooth information, and automated image analysis to help you decide which spots in a room you may want to look at more closely. You understand and agree that:

• The App is a supporting tool only. It is not a security device, a professional inspection, a surveillance-detection service or a substitute for a professional security sweep.
• Results are estimates and suggestions. They depend on your device's hardware and sensors, lighting, distance, the way you use the App, network conditions and many other factors outside our control, and they may be incomplete or wrong.
• The App may miss devices that are present ("false negatives") and may flag ordinary objects or devices ("false positives").
• AI-generated results are produced automatically and are not reviewed by a person.
• The App is not an emergency service. If you feel unsafe, contact local emergency services.
• You are solely responsible for how you interpret results and for any decision or action you take, or do not take, based on them.

3. Eligibility

You must be at least 13 years old, or the minimum age required in your country, to use the App. If you are under the age of legal majority where you live, you may use the App only with the consent of a parent or guardian.

4. Licence

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the App on devices you own or control, for your personal, non-commercial use, and as permitted by the usage rules of the Apple App Store or Google Play. You may not copy, modify, distribute, sell, rent or lease the App, or reverse engineer, decompile or try to extract its source code, except where the law allows this despite this restriction.

5. Using the App responsibly

You agree that you will:

• Use the App only in places where you are lawfully present, such as a room you have rented, and in line with all applicable laws.
• Scan only Wi‑Fi networks and devices you are authorised to access. Laws on scanning networks and devices differ between countries, and you are responsible for following the laws that apply to you.
• Not use the App to monitor, track, record or harass any person, or to violate anyone's privacy.
• Not open, damage, disable, remove or tamper with any device or property based on a result from the App.
• Not make accusations against any person based only on a result from the App.
• Not submit photos to the AI Scanner that you do not have the right to take, or that show other people without their permission.
• Not interfere with, disrupt or attempt to gain unauthorised access to the App or our servers.

6. If you find something

If you believe you have found a hidden device, do not touch or remove it. Leave the space if you feel unsafe and report it to the police, the property owner or manager, or your booking platform. We are not a party to your stay or booking and cannot investigate, verify or take action on your behalf.

7. Subscriptions and payments

Some features are free. Others require a paid subscription ("Premium"), which may be offered weekly, monthly, yearly or for another period shown in the App, and may include a free trial.

• Payment is charged to your Apple ID or Google Play account when you confirm the purchase, or when any free trial ends.
• Your subscription renews automatically at the same price and for the same period unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the App does not cancel your subscription.
• If you cancel, you keep access until the end of the period you have paid for. Any unused part of a free trial ends when you buy a subscription, where applicable.
• Refunds are handled by Apple or Google under their own policies. We cannot issue refunds for purchases made through their stores.
• We may change subscription prices. Apple or Google will let you know in advance as required, and you can cancel before the new price applies.

8. Third-party services

The App relies on third-party services, including AI providers, app stores and analytics providers, as described in our Privacy Policy. We are not responsible for third-party services, their availability or their content. Your use of them may also be subject to their own terms.

9. Intellectual property

The App and all its content, including its software, design, text, graphics, logos and trademarks, are owned by Moneo YAZILIM A.Ş. or its licensors and are protected by intellectual property laws. These Terms do not give you any rights to them except the limited licence in Section 4. If you send us feedback or suggestions, we may use them without any obligation to you.

10. Disclaimer of warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available," with all faults and without warranty of any kind. We expressly disclaim all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement and uninterrupted or error-free operation. We do not warrant that the App will detect or identify any device, that any result will be accurate or complete, or that any space is safe or free of recording devices. No advice or information you obtain from us or the App creates any warranty not expressly stated in these Terms.

11. Limitation of liability

To the maximum extent permitted by applicable law, Moneo YAZILIM A.Ş., its affiliates, and their directors, employees and suppliers will not be liable for any damages of any kind arising out of or related to your use of, or inability to use, the App, including any direct, indirect, incidental, special, consequential, exemplary or punitive damages, and any loss of privacy, personal injury, emotional distress, property damage, loss of data, loss of profits or costs of substitute services. This includes, without limitation, any harm resulting from a device that the App did not identify, from an object that the App flagged, or from any action you took based on a result.

Where our liability cannot be fully excluded under applicable law, our total liability to you for all claims will not exceed the amount you paid us for the App in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain warranties or liabilities to be excluded or limited. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for intentional misconduct or gross negligence where the law requires it, or rights you have as a consumer under mandatory law.

12. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless Moneo YAZILIM A.Ş. and its affiliates from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or the rights of another person.

13. Changes to the App and termination

We may change, suspend or discontinue the App or any feature at any time. We may suspend or end your access if you breach these Terms. You may stop using the App at any time by deleting it; remember to cancel any subscription through your App Store or Google Play account. Sections 2, 6 and 9 to 17 continue to apply after these Terms end.

14. Additional terms for Apple devices

If you downloaded the App from the Apple App Store, the following also applies:

• These Terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.
• Your licence to use the App is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing where applicable.
• Apple has no obligation to provide any maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are our responsibility, subject to these Terms.
• We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the App or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
• You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. Additional terms for Google Play

If you downloaded the App from Google Play, you also agree to the Google Play Terms of Service. These Terms are between you and us only, not with Google LLC, and Google is not responsible for the App or its content. Purchases are processed by Google Play and are subject to Google Play's payment and refund policies.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict of law rules. The courts and enforcement offices of Istanbul (Anadolu) have exclusive jurisdiction over any dispute arising from these Terms. If you are a consumer, this does not take away any protection given to you by the mandatory laws of the country where you live, or your right to bring a claim before the courts or consumer arbitration committees that those laws make available to you.

17. General

• These Terms and our Privacy Policy are the entire agreement between you and us about the App.
• If any part of these Terms is found to be invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of these Terms will remain in effect.
• If we do not enforce a right or provision, that is not a waiver of it.
• You may not transfer your rights under these Terms. We may transfer ours, for example as part of a merger or sale of our business.
• We may update these Terms from time to time. We will post the new version on this page and change the "Last updated" date, and let you know in the App if the changes are significant. If you continue to use the App after the changes take effect, you accept the updated Terms.
